Opening a Convenience Store in Kentucky: Licenses & Permits
Fuel tanks, beer, tobacco and vapor, food service, sales tax, fuel pumps and lottery: who issues each Kentucky license and what it means for your store design.
Updated October 26, 2026
Quick answer
In Kentucky, give the Division of Waste Management 14 days' notice before installing fuel tanks, which must be double-walled. Gas stations can sell beer under an NQ Retail Malt Beverage Package license if they stock at least $5,000 of groceries, but they can't hold the quota license needed for wine and spirits. Since 2026, tobacco and vapor sales need a $500-a-year ABC license. Food plans are approved by the local health department before construction.
In Kentucky, fuel and liquor don't mix: a store where gasoline is 10% or more of monthly receipts can't get the quota license needed for wine and spirits. It can sell beer, but only if it keeps $5,000 of groceries on hand. Kentucky also added a $500 tobacco and vapor license in 2026. Below is who issues what, and how each rule shapes the store you design.

Fuel tanks: the Division of Waste Management
The Energy and Environment Cabinet's Division of Waste Management regulates tanks under 401 KAR 42:
- Notice: file form DWM 4231 with the regional office at least 14 days before installing a tank or a full piping run, so an inspector can attend. If no inspector comes, the installation can go ahead.
- Construction: tanks and piping installed since April 1, 2012 must be double-walled. Repairs must be made by a contractor certified by the State Fire Marshal.
- Registration: file form DWM 4225 within 30 days of putting the system into use. The annual fee is $30 for each tank in the ground on July 1.
- Operators: designate a combined Class A/B operator within 30 days of registration, trained within 30 days of designation and retrained every year. Training is free online. Monthly and annual walkthrough inspections are required.
- Fund: the Petroleum Storage Tank Environmental Assurance Fund (PSTEAF), paid for by a fee of 1.4 cents a gallon on fuel, reimburses eligible cleanup costs. Reimbursements from its tank account run until July 15, 2034.
Beer: the NQ package license
Kentucky's Department of Alcoholic Beverage Control (ABC) issues licenses, alongside a local ABC administrator in each wet city or county:
- Beer: a convenience store sells beer under an NQ Retail Malt Beverage Package license, $210 a year in state fees.
- Grocery inventory: if the store sells gasoline, it must keep at least $5,000 of food, groceries and related products in inventory at cost. Hot food, alcohol and tobacco don't count.
- Wet, dry and moist: whether you can sell at all depends on local option elections. "Moist" areas allow only the sales approved by special elections.
- Notice: publish a notice in the local legal newspaper before applying. Anyone may protest within 30 days.
- Local fees: cities and counties may charge a regulatory license fee of up to 5% of alcohol receipts.
No wine or spirits with fuel. Wine and spirits to go need a quota retail package license, and KRS 243.230(5) bars it where staple groceries or gasoline are 10% or more of monthly gross receipts. Quota licenses are also capped by population. Since 2025, THC beverages may be sold only by quota package licensees, so they're out for gas stations too.
Tobacco and vapor: the new ABC license
Since 2026, retailers need an annual ABC Tobacco, Nicotine and Vapor Product license (SB 100 of 2025, amended in 2026):
- Fee: $500 per premises a year, plus a $50 application fee.
- Application: include a lease or landlord certification and proof of Department of Revenue registration.
- Posting: display the license where customers can see it.
- Vapor products: only authorized nicotine vapor products may be sold: FDA-authorized, or with a timely premarket application still pending.
Food service: the local health department
Local health departments issue retail food permits, with support from the state Food Safety Branch, under the 2013 FDA Food Code. Submit scaled plans to the local food safety specialist and the plumbing inspector, and start construction only after approval. The permit follows a passed opening inspection. State fees for a retail food store inspection are $90 up to 1,000 sq ft and $155 for 1,001 to 10,000 sq ft. A food service permit is $125 plus a seating charge, with $155 more for a drive-through.
Sales tax, fuel pumps and lottery
- Sales tax: register with the Department of Revenue. The rate is 6%, and Kentucky has no local sales taxes.
- Fuel pumps: the Department of Agriculture requires a Retail Motor Fuel license, $100 per facility a year, valid to January 31. Commercial devices are tested within 12 months or on the department's schedule.
- Lottery: apply to the Kentucky Lottery Corporation. The application fee is $250, or $100 per new outlet for an existing chain, with criminal and financial background checks. A bond or letter of credit may be required.
What this means for your store design
- Choose beer or liquor before you choose fuel. A gas-selling store can't get a quota license, so the alcohol section is beer only. All of it goes to the cooler wall or a beer cave.
- Plan shelving for $5,000 of groceries. The beer license at a gas station depends on that inventory, and hot food, alcohol and tobacco don't count toward it. See convenience store sizes.
- Check the wet or dry status of the site first. It's set by local elections, city by city and county by county. See choosing a location.
- Specify double-walled tanks and piping. Kentucky requires them for all new installations.
- Get food plans approved by both the health department and the plumbing inspector. Fees scale with floor area and seats. See food service build-outs.
Local approvals
Your city or county also controls zoning, building permits, fire inspections, signs and the local alcohol license. Our construction checklist covers the local steps.
