Opening a Convenience Store in New York: Licenses & Permits
Fuel tanks, beer, tobacco and vapor, food, sales tax, fuel pumps and lottery: who issues each New York license and what it means for your store design.
Updated October 25, 2026
Quick answer
In New York, petroleum tanks are registered with the Department of Environmental Conservation (DEC). Beer is sold under a State Liquor Authority grocery store beer license. Convenience stores can't sell wine (only wine products of 6% alcohol or less) or spirits. Cigarettes and vapor products each need a Tax Department registration. Food is licensed by the Department of Agriculture and Markets, and any food prep moves you to the food processing license. A sales tax Certificate of Authority is required at least 20 days before you open.
New York ties its beer license to the layout of the store: at least half the retail space must be food and household goods, and later changes to the floor plan need approval. It also has one of the strictest food-licensing lines in the country, where even a coffee or fountain dispenser can change your license. Below is who issues what, and how each rule shapes the store you design.

Fuel tanks: DEC petroleum bulk storage
The Department of Environmental Conservation regulates petroleum tanks under 6 NYCRR Part 613:
- Registration: required for an underground tank over 110 gallons, or more than 1,100 gallons combined. It renews every five years and on any change of ownership. DEC's five-year fee runs from $0 for up to 1,100 gallons to $500 for 5,000 to under 400,000 gallons.
- Before installation: DEC's pre-work notification form asks owners to notify DEC at least 30 days before installing a tank. You need the registration certificate before the first fuel delivery.
- Operators: Class A and B operators must pass DEC's free online exam, and every on-site person who can respond to emergencies is designated Class C. A new facility designates its operators before the first delivery.
- County programs: Nassau, Suffolk, Westchester and Cortland counties run their own tank programs, which may be stricter.
- Cleanup: owners are strictly liable for discharges (Navigation Law §181). DEC can pay for a cleanup and then recover the cost from the responsible party, so this isn't insurance. Owners still need their own financial responsibility.
Beer: the grocery store license
Convenience stores sell beer under the State Liquor Authority's grocery store licenses: Grocery Store Beer (beer, cider and mead) or Grocery Store Beer and Wine Products. According to the SLA:
- Space rule: at least 50% of the retail space must be food (not counting alcohol or soda), household and hygiene items.
- Term and fee: licenses run three years, and the fee depends on the county. A conditional approval doesn't allow sales.
- Floor plan changes: file an alteration application before enlarging or shrinking the store, or making any physical change that reduces visibility.
- Control and signs: the licensee must have exclusive control of the premises. The license hangs framed behind glass, and the pregnancy warning sign goes as close as possible to where alcohol is sold.
No wine or spirits. "Wine products" are capped at 6% alcohol (ABC Law §3). A bill to allow wine in larger supermarkets (S1279-A) went back to committee on January 7, 2026. Liquor stores can't run any other business on the premises (ABC Law §63).
Tobacco and vapor
The Tax Department requires two separate registrations, each $300 per location per year:
- Retail cigarette dealer registration (Form DTF-716): file at least 30 days before you start selling, and display the certificate.
- Vapor products dealer registration: a cigarette registration doesn't cover vapes. You need a sales tax registration first, and renewals are September 1 to 20.
New York City adds its own tobacco and e-cigarette dealer licenses, capped by community district. Available licenses are given out by lottery, with applications from November 2 to 30, 2026.
Food: Agriculture and Markets
The Department of Agriculture and Markets licenses food sold in stores, and the line between its two licenses is tight:
- Retail food store license: $250 for two years, only if the store does no food processing.
- Food processing license (Article 20-C): $400 for two years. Any prep needs it, including making sandwiches, heating or slicing food, and running beverage dispensers.
Restaurant-style food service and seating fall under the local health department. Ask both agencies about plan review before you build.
Sales tax, fuel pumps and lottery
- Sales tax: register for a Certificate of Authority through NY Business Express at least 20 days before starting business. The penalty for operating without one can reach $10,000.
- Fuel pumps: the Department of Agriculture and Markets supervises weights and measures, and inspections are done by county and city offices. Skimmer checks are part of routine inspections.
- Lottery: apply for a lottery license with the NY Gaming Commission. The store must have operated under its sales tax ID for at least three weeks. A site inspection and fingerprints for each owner are required.
What this means for your store design
- Plan the 50% food space on the floor plan. Beer, soda and the cooler wall don't count toward it, so gondola space for food and household goods has to carry half the store. Check it on the floor plan before you size the cooler wall.
- Get later layout changes approved. Remodels that enlarge or shrink the store or reduce visibility need an SLA alteration application first.
- Decide your food program up front. A coffee bar, fountain or sandwich station puts you under the 20-C license. Seating and restaurant service bring in the local health department. See the kitchen floor plan and food service build-outs.
- No wine or liquor department. Alcohol space is beer, cider and low-alcohol wine products.
Local approvals
Your city, town or county also controls zoning, building permits, fire inspections and signs, and New York City has its own licensing. Our construction checklist covers the local steps.
